RAY BROOK, NY – Adirondack Park Agency reports full compliance with APA Act for Lake Clear homeowner.
The Adirondack Park Agency announced on November 16, 2007 that its Enforcement Committee accepted a resolution for the Matter of Hickey, et al. The matter drew media attention after deliberation before the Agency in October 2007. E. James Hickey, Jr., Kevin Hickey and Syracuse contractor Rob MacKaig said that they would comply with the Enforcement Committee’s October 16, 2007 determination and bring the single family home on Lake Clear into full compliance with the APA Act and related permit conditions in its present location.
The Agency determination in October involved different options. In the final resolution, they agreed to:
• Pay a $50,000 civil penalty;
• Remove the deck from E. James Hickey’s house that was constructed within the shoreline setback of Lake Clear;
• Paint or stain E. James Hickey’s house dark earth-tone colors to reduce its visual impacts;
• Plant trees and other vegetation to fully screen E. James Hickey’s house from Lake Clear; and
• Record new deeds prohibiting any additional single family dwellings on their Resource Management lands and restrict development along a portion of Kevin Hickey’s shoreline.
APA Chairman Stiles welcomed the decision to comply stating, “This decision ensures full compliance for the Hickeys’ Lake Clear properties. Their willingness to resolve this matter resulted in prompt closure which the Agency appreciates.”
