RAY BROOK - Proposed draft changes to Adirondack Park Agency regulations will be the subject of four public hearings scheduled for January and February 2002. The Governor’s Office of Regulatory Reform (GORR) recently authorized the Agency to proceed to formal rule making and hearing on the proposed changes pursuant to the New York State Administrative Procedure Act.
GORR’s approval of the proposed changes authorizes the Agency to begin a formal public rule making process on elements of Parts 570, 573, 574, 575, 577, and 580 of its regulations involving definitions and related companion changes. The proposed changes, covering regulatory terms including accessory structure, accessory use, bed and breakfast, boathouse, customarily incidental, dock, group camp, guest cottage, marina, material detrimental reliance, retaining wall, and structure were developed over the past several years following public review and comment.
The formal rule making process begins with publication of a notice of the proposed rule making in the New York State Register. This notice appeared December 12, 2001 and included information on the proposed changes and a schedule of the dates, times, and locations for the four public hearings.
The public hearings, combined to satisfy both State Administrative Procedure Act and State Environmental Quality Review Act requirements, will be held both inside and outside the Park. The dates, times, and locations of these hearings are as follows:
Tuesday, January 29, 2002 7:00 p.m. Indian Lake Town Hall, Pelon Road, Indian Lake, New York
Wednesday, January 30, 2002 7:00 p.m. North Country Community College, Petty Lecture Hall, Science Building, Saranac Lake, New York
Tuesday, February 5, 2002 2:00 p.m. Public Service Commission, Conference Room F, 8th Floor, 1 Penn Plaza, New York City, New York
Wednesday, February 6, 2002 7:00 p.m. Colonie Community Center, Auditorium, 1653 Central Avenue, Albany, New York
At the hearings, the public will be asked to consider the draft changes presented in the State Administrative Procedure Act Regulatory Impact Statement and the related Draft Supplemental Generic Environmental Impact Statement. Following the hearings, and a short continuation of the public comment period and development of any necessary revisions, the Agency will follow a sequence that includes preparation of a Final Supplemental Generic Environmental Impact Statement, issue a findings statement, adopt the rule changes and publish them in the State Register.
